1. Scope and Acceptance

These Terms of Service ("Terms") govern your use of the RealRecipe mobile application ("App") and related services ("Services"), operated by Rouven Grassberger ("we", "us", "our"), Gießener Straße 68, 60435 Frankfurt am Main, Germany.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and us in accordance with §§ 305 ff. BGB (German Civil Code).

2. Description of Service

RealRecipe is a mobile application that allows users to:

Import and save recipes from social media platforms (including TikTok, Instagram, and YouTube) and websites
Import recipes by photographing physical cookbooks or printed recipes
Organize, search, and manage a personal digital recipe collection
Follow step-by-step cooking instructions with a dedicated cook mode
Adjust ingredient quantities for different serving sizes and convert measurement units

The extraction of recipes is facilitated by artificial intelligence ("AI"). We do not guarantee the accuracy, completeness, or correctness of AI-generated results. Users are responsible for reviewing imported recipes for accuracy before use, particularly regarding allergens, dietary restrictions, and nutritional information.

3. User Accounts and Registration

To use the App, you must create an account via Apple Sign-In, Google Sign-In, or email registration. You must be at least 16 years old to use the App. By creating an account, you represent and warrant that:

All information provided is accurate, current, and complete
You will maintain the accuracy of such information
You are at least 16 years old
Your use of the App does not violate any applicable law or regulation

You are responsible for safeguarding the credentials used to access your account and for all activity occurring under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use and Fair Use Policy

The App is provided for personal, non-commercial use only. You agree to use the Services in a reasonable and responsible manner, consistent with the intended purpose of a personal recipe collection tool.

4.1 Fair Use Policy

To ensure a reliable and equitable experience for all users and to maintain the integrity of our infrastructure, we enforce reasonable usage limits on the Services. These limits are designed to accommodate normal, personal usage patterns and may be adjusted from time to time at our sole discretion.

We reserve the right to monitor usage patterns and to restrict, throttle, suspend, or terminate access to the Services—with or without prior notice—if we determine, in our reasonable judgment, that usage:

Is excessive relative to typical personal usage patterns
Places disproportionate load on our infrastructure or third-party services
Suggests automated, scripted, or bot-driven activity
Is inconsistent with the intended purpose of personal recipe collection
Adversely affects the availability, performance, or quality of the Services for other users

Specific usage quotas and rate limits may be communicated within the App and may vary by subscription tier. Free-tier accounts are subject to more restrictive usage limits. These quotas are subject to change and are incorporated into these Terms by reference.

4.2 Prohibited Uses

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable law or regulation
Use automated tools, scripts, bots, crawlers, scrapers, or similar technology to access or interact with the Services
Systematically download, cache, or bulk-extract recipes or data from the Services for any purpose, including but not limited to building datasets, training AI/ML models, or populating competing services
Attempt to circumvent, disable, or interfere with any security, access control, or rate-limiting features of the App or Services
Decompile, reverse-engineer, disassemble, or otherwise attempt to derive the source code of the App
Access or use the Services to create a competing product or service
Redistribute, sublicense, resell, or commercially exploit any content obtained through the Services
Share, transfer, or facilitate access to your account or subscription with third parties
Use the App in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party's use of the Services
Create multiple accounts to circumvent usage restrictions or for any other abusive purpose
Upload or transmit any malicious software, viruses, or harmful code

5. Copyright and Intellectual Property

5.1 Our Intellectual Property

The App, including its design, code, features, documentation, logos, trademarks, and all original content, is owned by Rouven Grassberger and is protected by German and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms. This license does not transfer any ownership or intellectual property rights to you.

5.2 Third-Party Content

Recipes imported from third-party platforms may be subject to the copyright and intellectual property rights of their respective creators. RealRecipe provides a tool to assist in the personal organization of recipes and does not claim ownership of any imported content.

You acknowledge and agree that:

You are solely responsible for ensuring that your use of imported content complies with applicable copyright laws and the terms of service of the originating platforms
The redistribution, publication, or commercial use of imported recipes without the consent of the original creator is strictly prohibited
We do not verify the copyright status of imported content and assume no liability for infringement by users

6. Subscriptions and Payments

6.1 Free and Paid Tiers

The free version provides a limited number of recipe imports (credits)
RealRecipe Pro provides access to enhanced features, including increased or unlimited recipe imports
Specific features and limits for each tier are described within the App and may be updated from time to time

6.2 Billing and Renewals

All subscriptions are billed through the Apple App Store
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
Cancellation is managed through your Apple ID account settings
We may offer a free trial period; if not cancelled before the trial ends, your subscription will convert to a paid subscription at the advertised price

6.3 Refunds

Refund requests are subject to Apple's refund policies. We do not process refunds directly. Please contact Apple Support for refund inquiries. Downgrading or cancelling a subscription does not entitle you to a refund for any previously charged amount.

6.4 Price Changes

We reserve the right to modify subscription pricing. Price changes will be communicated in advance and will apply from the next billing period. Continued use after a price change constitutes acceptance of the new pricing.

7. Service Availability and Modifications

We strive to maintain the availability of the Services but do not guarantee uninterrupted or error-free operation. We reserve the right to:

Modify, update, or discontinue features of the App at any time with reasonable notice
Perform scheduled or emergency maintenance that may temporarily limit availability
Discontinue support for specific third-party platforms if technically necessary or legally required

Recipe extraction depends on the availability and structure of third-party platforms. We are not responsible for changes to third-party services that affect the functionality of the App.

8. Limitation of Liability

The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, to the fullest extent permissible under applicable law.

We do not warrant or accept liability for:

The accuracy, completeness, or nutritional correctness of AI-extracted recipes
Allergic reactions, adverse health effects, food safety issues, or any bodily harm resulting from recipes obtained through the Services
The availability, accuracy, or legality of content on third-party platforms
Loss of data stored on your device or in your account
Interruptions, errors, or defects in the Services

To the maximum extent permitted by applicable law (including §§ 521 et seq. BGB for gratuitous services), our total aggregate liability to you for all claims arising out of or in connection with the use of the Services shall not exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to such liability.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit); or (d) any other liability that cannot be excluded or limited under applicable law, including mandatory consumer protection provisions.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rouven Grassberger from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party, including intellectual property rights; or (d) your violation of any applicable law.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account, with or without prior notice, if:

You violate these Terms, including the Fair Use Policy or Acceptable Use requirements
Your usage patterns are, in our reasonable judgment, abusive, excessive, or abnormal
We are required to do so by law or regulatory mandate
Your account has been inactive for an extended period

You may delete your account at any time through the App settings (Profile → Settings → Delete Account). Upon deletion, your data will be removed in accordance with our Privacy Policy. Termination does not relieve you of any obligations or liabilities incurred prior to termination.

11. Data Protection

Your privacy is important to us. Our collection and use of personal data is described in our Privacy Policy, which is incorporated into and forms part of these Terms. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated to you via the App or by email at least thirty (30) days before they take effect. If you do not agree to the modified Terms, you must discontinue your use of the App before the effective date of the changes. Continued use of the App after the effective date constitutes your acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Frankfurt am Main, Germany.

If you are a consumer residing in the European Union, you additionally benefit from the mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU or national consumer protection legislation.

14. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose and intent of the invalid provision.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
